Appeal and Cassation in Criminal Proceedings

Regional appellate review and cassation are separate remedies. The available route, competent court, deadline, review scope and form of the application depend on the judgment and the procedural rules in force.

Regional appellate review

An appeal to the regional court may involve review of facts, evidence, legal characterisation and procedure within the statutory framework. The chamber may decide on the file or hold a hearing where required.

Cassation

Cassation before the Court of Cassation primarily examines legal compliance within the scope allowed by the Code. Not every appellate decision is open to cassation.

Reasoned application

The challenged findings, procedural error or legal issue should be identified precisely. A generic statement may fail to explain the requested review.

Durations and procedures may vary depending on the nature of the file. Current legislation and official sources should be taken as basis.
