Representation of Victims, Complainants and Intervening Parties

A person harmed by an alleged offence may hold different procedural positions as victim, complainant or intervening party. Each position carries a particular set of participation and notification rights.

Victim and complainant

The file should distinguish the person directly harmed, the person making a complaint and any legal representative. Complaint requirements vary by offence.

Intervention

A request to participate as an intervening party is considered by the competent criminal court under statutory conditions and within the procedural stage allowed by law.

Participation in evidence

Representation may include presenting documents, requesting relevant investigative or trial steps, addressing expert material and making submissions within the person’s procedural status.

Durations and procedures may vary depending on the nature of the file. Current legislation and official sources should be taken as basis.
